Is there a possibility that even Jnode would face the same issues as Google is facing from Oracle with respect to Java Intellectual Property?

I am not a lawyer…
But:
1. As long as software patents exist, no software is safe from issues related to "Intellectual Property" (I don't know what intellectual property should be – i prefer it doesn't exist)
2. If Oracle wins this case most Software whould be exposed to somehow random legal action since almost any software uses some kind of design patterns, API, …
